Acknowledgment vs. Jurat:

The main difference lies in what the notary is certifying: the identity of the signer or the truthfulness of the content.

1. The Acknowledgment

  • The Goal: To confirm that you are who you say you are and that you signed the document voluntarily.
  • The Process: You simply declare (acknowledge) to the notary that the signature on the document is yours.
  • Key Detail: In many states, you can actually sign the document before you meet with the notary, as long as you personally appear before them to acknowledge the signature later.
  • Commonly used for: Deeds, powers of attorney, and business agreements.

2. The Jurat (Verification on Oath)

  • The Goal: To compel the signer to tell the truth.
  • The Process: The notary will ask you to take an oath or affirmation (e.g., "Do you swear that the contents of this document are true?").
  • Key Detail: You must sign the document in the presence of the notary. If you sign it beforehand, the notary will have you sign it again during the session.
  • Commonly used for: Affidavits, depositions, and court-related documents.

Important Reminder: The notary's job is to witness the signing and verify your identity. They cannot draft your document, give legal advice, or tell you which certificate to choose.
